1. Acceptance of Terms

By accessing or using InsiQuest LocalWatch, you represent that you are legally capable of entering into a binding agreement and that you have read, understood, and agreed to these Terms and the InsiQuest LocalWatch Privacy Policy.

If you use the Organization Portal on behalf of a nonprofit, business, government agency, school, community group, or other organization, you represent that you have authority to act on behalf of that organization.

2. LocalWatch Services

LocalWatch may provide residents with access to:

Local news and public information;
Public-safety alerts;
Weather alerts and notices;
Traffic and road information;
Construction and infrastructure information;
Government and public meeting information;
Community events;
Participating organization profiles;
Community resources and services;
Programs and local opportunities;
Registrations and forms;
Event check-ins;
Saved places and local alert preferences;
Push, SMS, and email notifications;
Other local-information features made available through the service.

We may add, remove, modify, suspend, or discontinue LocalWatch features as the service evolves.

3. Resident Accounts

Some LocalWatch features may require a resident account.

You agree to provide accurate, current, and complete information when creating or maintaining your account.

You are responsible for activity conducted through your account;
You are responsible for maintaining control of the mobile phone, email account, and devices associated with your account;
You may not allow another person to impersonate you through your LocalWatch account;
You must notify us if you believe your account has been accessed without authorization;
You may not create accounts using false or misleading identifying information.

LocalWatch may use mobile-phone verification, one-time codes, email, or other authentication methods to protect account access.

4. Local Information and Public Sources

LocalWatch collects, organizes, summarizes, and displays information from government agencies, public records, public websites, community organizations, transportation services, weather services, event publishers, and other public or third-party sources.

LocalWatch may summarize or reorganize source information so that it is easier for residents to understand and discover.

Although we make reasonable efforts to provide useful and accurate information, LocalWatch does not guarantee that every item is complete, current, error-free, or available at all times.

When important decisions depend on particular information, users should review the original or authoritative source.

5. Emergency and Public-Safety Information

LocalWatch may display or send information concerning public safety, crime, weather, traffic, emergencies, utility outages, road closures, or other potentially urgent conditions.

LocalWatch is not an emergency dispatch service, government alerting authority, law-enforcement agency, weather authority, utility provider, or replacement for official emergency communications.

Alerts and notifications may be delayed, unavailable, incomplete, inaccurate, or affected by:

Third-party source delays;
Internet outages;
Mobile-network conditions;
Push-notification delivery failures;
Device settings;
Service outages;
Other circumstances outside our control.

In an emergency, call 911 or follow instructions from appropriate government and emergency authorities. Do not rely solely on LocalWatch for emergency information.

6. Saved Places and Location Features

LocalWatch may allow residents to enter or save addresses or other locations, such as home, work, school, or another place that matters to them.

Saved places may be used to identify local information within a selected area or notification radius.

You are responsible for ensuring that addresses and location information you enter are accurate.

A LocalWatch alert associated with a saved place does not mean that the event occurred at the exact address you entered. Depending on the source and alert type, an alert may relate to a broader surrounding area.

7. Participating Organizations

LocalWatch may allow organizations to maintain public profiles and publish community resources, programs, services, events, opportunities, forms, and related information.

Participating organizations are responsible for the accuracy, legality, and completeness of information they publish through the Organization Portal.

Unless expressly stated otherwise, inclusion of an organization, program, service, event, resource, or opportunity in LocalWatch does not constitute endorsement, certification, sponsorship, approval, or recommendation by Best Partner Media LLC.

Residents are responsible for evaluating whether a particular organization, service, opportunity, program, or event is appropriate for them.

8. Organization Portal Accounts

The InsiQuest Organization Portal is intended for authorized representatives of participating organizations.

Organization users agree that they will:

Provide accurate organization information;
Use the Organization Portal only for organizations they are authorized to represent;
Keep organization contact and public profile information reasonably current;
Publish only programs, services, resources, events, and opportunities they are authorized to publish;
Protect access to organization accounts and resident information;
Restrict access to resident information to authorized individuals;
Use resident information only for lawful organization purposes;
Comply with laws applicable to the organization's programs, services, communications, and data collection.

9. Registrations, Forms, and Event Check-Ins

LocalWatch may allow residents to register for programs or opportunities, submit forms, or check in to events operated by participating organizations.

The participating organization determines the purpose of its program, eligibility criteria, form questions, requested information, event requirements, and how organization-specific information will be used.

Submission of a registration or form does not guarantee:

Acceptance into a program;
Eligibility for a service or benefit;
Employment;
Housing;
Financial assistance;
A reservation or event seat;
Approval of an application;
Any other particular outcome.

Decisions concerning programs, applications, eligibility, benefits, services, opportunities, or event participation are made by the applicable organization, not by LocalWatch unless expressly stated.

10. Organization Responsibility for Resident Information

Organizations using LocalWatch forms, registrations, events, or engagement tools are responsible for the information they request from residents and how that information is used.

Organizations agree that they will:

Collect only information they have a lawful and legitimate reason to collect;
Provide notices or obtain consent where required by applicable law;
Use resident information only for lawful purposes associated with their programs, services, events, or operations;
Protect resident information from unauthorized access or misuse;
Honor privacy, confidentiality, access, correction, or deletion obligations applicable to the organization;
Avoid misleading, discriminatory, fraudulent, coercive, or deceptive collection practices.

InsiQuest does not determine whether an organization's particular form, eligibility requirement, application process, disclosure, or use of resident information complies with every law applicable to that organization.

11. User and Organization Content

Users and organizations retain their rights in content they submit through LocalWatch, including organization descriptions, program information, event information, forms, images, uploaded files, and other original material.

You grant Best Partner Media LLC a limited, non-exclusive license to host, store, process, copy, transmit, display, format, and otherwise use submitted content as reasonably necessary to operate, secure, maintain, distribute, and improve LocalWatch.

Organizations grant InsiQuest permission to display information they publish through the Organization Portal to residents through LocalWatch and related InsiQuest services.

You represent that you have the rights and permissions necessary to upload, publish, process, and use content associated with your account.

12. Artificial Intelligence and Automated Processing

InsiQuest may use artificial intelligence and automated systems to help collect, classify, summarize, organize, normalize, or display local information.

AI or automated systems may also assist participating organizations with certain platform functions, such as creating forms or organizing information.

AI-generated or automatically processed information may be incomplete, inaccurate, outdated, or unsuitable for a particular purpose.

Users should review authoritative sources when important decisions depend on information displayed through LocalWatch.

AI-generated information does not constitute legal, medical, financial, employment, housing, emergency, government, or other professional advice.

13. Prohibited and Sensitive Information

Unless InsiQuest expressly agrees otherwise in writing, users and participating organizations may not intentionally use LocalWatch to collect or store:

Passwords or authentication credentials belonging to another person;
Complete payment-card or banking credentials;
Social Security numbers or equivalent national identification numbers;
Information obtained through unlawful surveillance, fraud, or deception;
Information that the user or organization is legally prohibited from collecting or processing;
Protected health information subject to HIPAA where no applicable written agreement authorizes such processing;
Highly sensitive information where collection or processing would violate applicable privacy, education, employment, housing, consumer-protection, or data-protection laws.

Organizations are responsible for determining whether information they collect is regulated and whether additional safeguards, agreements, notices, permissions, or consent are required.

14. Acceptable Use

You may not use LocalWatch or the Organization Portal to create, publish, transmit, collect, promote, or distribute content or activity that:

Is unlawful, fraudulent, deceptive, defamatory, or misleading;
Infringes intellectual-property, privacy, publicity, contractual, or other rights;
Contains threats, harassment, hate speech, exploitation, or incitement to violence;
Exploits or endangers children or vulnerable individuals;
Promotes unlawful products, services, conduct, or transactions;
Contains malware, malicious code, phishing, spam, credential theft, or harmful software;
Attempts to interfere with or bypass platform security;
Scrapes, overloads, reverse engineers, or disrupts the platform;
Falsely suggests endorsement, affiliation, sponsorship, or approval by InsiQuest, a government agency, or another organization;
Uses LocalWatch to discriminate unlawfully or facilitate prohibited decision-making.

We may investigate suspected misuse and may remove content, restrict features, suspend accounts, preserve evidence, or cooperate with lawful investigations where appropriate.

15. Communications and Notifications

LocalWatch may provide push notifications, SMS messages, email communications, or in-app notices relating to:

Authentication and phone verification;
Public-safety information;
Weather alerts;
Traffic or infrastructure information;
Saved places;
Local events;
Programs or opportunities;
Registrations or event interactions;
Account security;
Service changes;
Support;
Legal notices.

Notification delivery is not guaranteed. Device settings, browser settings, network conditions, third-party providers, operating-system restrictions, or other technical conditions may prevent or delay delivery.

Standard messaging and data rates may apply to SMS communications.

16. Free Resident Access

LocalWatch resident access is currently provided without a paid subscription.

Best Partner Media LLC may introduce, modify, or discontinue optional features, organization services, sponsorship programs, advertising, or paid services in the future.

Any future paid service will be subject to the pricing, billing terms, and conditions presented when that service is offered.

17. Account Suspension, Termination, and Deletion

You may stop using LocalWatch at any time. Account-deletion options may be available through account settings or by contacting support.

We may suspend, restrict, or terminate access when we reasonably believe that:

You violated these Terms;
Your activity creates legal, security, or operational risk;
Your account is being used fraudulently or without authorization;
You are impersonating another person or organization;
You misuse resident or organization information;
Suspension is required by law or valid governmental request.

Following deletion or termination, information may remain temporarily in backups, logs, security records, organization records, or other systems where retention is reasonably necessary or legally required.

Information a resident previously submitted to a participating organization may remain part of that organization's records where the organization is independently permitted or required to retain it.

18. InsiQuest Intellectual Property

InsiQuest and LocalWatch software, source code, platform design, trademarks, logos, branding, interfaces, documentation, templates, databases, and related materials are owned by Best Partner Media LLC or its licensors.

These Terms do not transfer ownership of InsiQuest intellectual property to you.

You may not copy, resell, sublicense, modify, reverse engineer, distribute, or create derivative services from InsiQuest or LocalWatch except as expressly permitted by law or in writing.

19. Third-Party Services and Links

LocalWatch may rely on or link to third-party services for hosting, storage, artificial intelligence, geocoding, maps, email, SMS, notifications, authentication, public information, events, or other functions.

LocalWatch may also link residents to websites operated by government agencies, participating organizations, employers, housing providers, service providers, event organizers, and other third parties.

Third-party services are governed by their own terms and privacy practices.

Best Partner Media LLC is not responsible for the content, availability, accuracy, privacy practices, security, products, services, decisions, or actions of third parties outside its reasonable control.

20. Service Availability and Disclaimers

InsiQuest LocalWatch is provided on an “as is” and “as available” basis to the fullest extent permitted by law.

We do not guarantee that:

The platform will always be available or uninterrupted;
Every feature will operate without error;
Every local event or public notice will be discovered or published;
Notifications will always be delivered;
Third-party information will always be accurate or current;
AI-generated summaries or classifications will always be accurate;
A program, opportunity, service, organization, resource, or event will remain available;
A resident will qualify for or receive any particular service, opportunity, benefit, housing, employment, assistance, or program;
LocalWatch will meet every individual legal, professional, or personal need.

Scheduled maintenance, emergencies, source changes, third-party outages, security events, internet failures, mobile-network conditions, or circumstances outside our control may affect service availability.

21. Limitation of Liability

To the fullest extent permitted by law, Best Partner Media LLC and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to InsiQuest LocalWatch.

This includes damages relating to:

Service interruptions;
Missed or delayed notifications;
Reliance on local information or automated summaries;
Third-party information;
Program or opportunity decisions;
Actions of participating organizations;
Unauthorized account activity;
Loss or corruption of data;
Lost opportunities or economic losses;
Other circumstances arising from use of the service.

Because resident access to LocalWatch is currently free, and to the fullest extent permitted by applicable law, the aggregate liability of Best Partner Media LLC for claims arising solely from a resident's free use of LocalWatch will not exceed one hundred U.S. dollars ($100).

For an organization or other user that has paid Best Partner Media LLC for a service, the aggregate liability of Best Partner Media LLC for claims arising from that paid service will not exceed the amount paid by that user to Best Partner Media LLC for the applicable service during the twelve months immediately preceding the event giving rise to the claim.

Some jurisdictions do not permit certain exclusions or limitations of liability, so portions of this section may not apply to you.

22. Indemnification

To the extent permitted by law, organization users and other users who publish content or collect information through the platform agree to defend, indemnify, and hold harmless Best Partner Media LLC and its owners, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from:

Content they publish through LocalWatch;
Their programs, resources, opportunities, events, or services;
Their collection or use of resident information;
Their violation of these Terms;
Their violation of applicable law;
Their infringement of another person's rights;
Their misuse of LocalWatch or the Organization Portal.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes in LocalWatch, the Organization Portal, business practices, legal requirements, technology, or security needs.

Updated Terms become effective when posted unless a later effective date is stated.

Where appropriate or legally required, we may provide additional notice through LocalWatch, email, SMS, push notification, or the Organization Portal.

Continued use of LocalWatch after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

24. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law rules.

Any dispute that is not otherwise resolved by agreement will be brought in a court of competent jurisdiction located in New Jersey, unless applicable law requires a different location or procedure.

25. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Failure to enforce a provision does not waive our right to enforce it later.

You may not transfer your rights or obligations under these Terms without written permission from Best Partner Media LLC.

Best Partner Media LLC may transfer these Terms as part of a merger, acquisition, reorganization, financing, or sale of assets.

These Terms and the Privacy Policy constitute the agreement between you and Best Partner Media LLC regarding your use of InsiQuest LocalWatch, except where a separate written agreement applies.
