Terms of Use

These Terms govern your access to and use of the InsiQuest survey, feedback, analytics, respondent-management, and related services.

Effective July 11, 2026
InsiQuest is an AI-powered survey and feedback platform operated by Best Partner Media LLC. By creating an account, accessing the platform, or using any InsiQuest service, you agree to these Terms of Use. If you do not agree to these Terms, you may not use InsiQuest.

1. Acceptance of Terms

By accessing or using InsiQuest, you represent that you are legally capable of entering into a binding agreement and that you have read, understood, and agreed to these Terms and the InsiQuest Privacy Policy.

If you use InsiQuest on behalf of a business, organization, agency, school, nonprofit, or other entity, you represent that you have authority to bind that entity to these Terms.

2. InsiQuest Services

InsiQuest provides tools that may allow users to:

  • Create, edit, publish, and share surveys and feedback forms;
  • Generate survey content using artificial intelligence;
  • Use industry-specific survey templates;
  • Collect, review, analyze, and export survey responses;
  • Capture and manage respondent contact information;
  • Maintain respondent profiles, notes, activity, and follow-up reminders;
  • Use branded survey links, QR codes, or subdomains;
  • Access other features made available through the platform.

We may add, remove, modify, suspend, or discontinue features as the platform evolves.

3. Accounts and User Responsibilities

You agree to provide accurate, current, and complete information when creating and maintaining your account.

  • You are responsible for protecting your account credentials.
  • You are responsible for activity conducted through your account.
  • You may not share credentials in a manner that compromises account or platform security.
  • You must notify us promptly if you believe your account has been accessed without authorization.
  • You may not impersonate another person, business, organization, or government entity.

4. Survey Creator Responsibilities

Users who create or distribute surveys are responsible for the surveys they publish, the information they request, and how collected information is used.

You agree that you will:

  • Collect only information you have a lawful and legitimate reason to collect;
  • Provide respondents with any notices, disclosures, or consent requests required by applicable law;
  • Accurately identify yourself or your organization when anonymity would be deceptive or unlawful;
  • Use responses and respondent information only for lawful purposes;
  • Honor any privacy, confidentiality, deletion, or access obligations that apply to your survey activity;
  • Avoid using misleading, coercive, fraudulent, or deceptive survey practices.

InsiQuest does not determine whether a particular survey, question, disclosure, or use of respondent information complies with laws that apply to you. You are responsible for making that determination.

5. Respondent Data and User Content

As between you and InsiQuest, you retain ownership of the surveys, questions, responses, respondent information, uploaded files, organization branding, and other content you submit to the platform.

You grant Best Partner Media LLC a limited, non-exclusive license to host, store, copy, process, transmit, display, and otherwise use that content only as reasonably necessary to operate, secure, maintain, and improve the InsiQuest services.

You represent that you have the rights and permissions necessary to upload, process, and use the content and data associated with your account.

Respondents may provide information directly through surveys created by InsiQuest users. The survey creator generally determines why that information is collected and how it is used. InsiQuest processes that information to provide the platform and related services.

6. Artificial Intelligence Features

InsiQuest may use artificial intelligence to assist with survey creation, question wording, template customization, summaries, categorization, analytics, or other platform functions.

AI-generated content may be incomplete, inaccurate, inappropriate, biased, or unsuitable for a particular purpose. You are responsible for reviewing and approving all AI-generated content before publishing, distributing, or relying upon it.

InsiQuest does not guarantee that AI-generated questions, summaries, recommendations, or insights are accurate, lawful, unbiased, or suitable for your business, audience, or industry.

You should not rely on AI-generated output as legal, medical, financial, employment, compliance, or other professional advice.

7. Prohibited and Sensitive Information

Unless InsiQuest expressly agrees otherwise in writing, you may not use the platform to collect or store:

  • Passwords or authentication credentials belonging to respondents;
  • Complete payment-card or banking credentials;
  • Social Security numbers or equivalent national identification numbers;
  • Information obtained through unlawful surveillance or deception;
  • Information you are legally prohibited from collecting or processing;
  • Protected health information subject to HIPAA where no applicable written agreement authorizes such processing;
  • Highly sensitive information where your use of InsiQuest would violate applicable privacy, consumer-protection, employment, education, or data-protection laws.

You are responsible for determining whether the information you collect is regulated and whether additional safeguards, agreements, permissions, or disclosures are required.

8. Acceptable Use

You may not use InsiQuest to create, publish, transmit, collect, promote, or distribute content or activity that:

  • Is unlawful, fraudulent, deceptive, defamatory, or misleading;
  • Infringes intellectual-property, privacy, publicity, contractual, or other rights;
  • Contains threats, harassment, hate speech, or incitement to violence;
  • Exploits or endangers children or vulnerable individuals;
  • Promotes unlawful products, services, conduct, or transactions;
  • Contains malware, malicious code, phishing, spam, or credential theft;
  • Attempts to interfere with or bypass platform security;
  • Scrapes, overloads, reverse engineers, or disrupts the platform;
  • Falsely suggests endorsement, sponsorship, affiliation, or approval by another person or organization;
  • Uses surveys to discriminate unlawfully or make prohibited automated decisions about respondents.

We may investigate suspected misuse and may remove content, restrict surveys, suspend accounts, preserve evidence, or cooperate with lawful investigations when appropriate.

9. Subscriptions, Trials, and Billing

Some InsiQuest features require a paid subscription. Prices, trial periods, billing intervals, taxes, and plan details are displayed at the time of purchase.

Unless otherwise stated, paid subscriptions automatically renew at the end of each billing period until canceled.

Subscriptions purchased through the Apple App Store are billed and managed through the user’s Apple account and are subject to the applicable Apple billing and cancellation terms.

Subscriptions purchased directly through InsiQuest are billed through the payment provider identified during checkout.

Canceling a subscription generally prevents future renewal but does not automatically provide a refund for the current billing period. Refunds, when available, are governed by the applicable billing provider, purchase terms, and applicable law.

We may change pricing or plan features. When required, notice will be provided before revised pricing applies to a future billing period.

10. Account Suspension, Termination, and Deletion

You may stop using InsiQuest at any time. Account-deletion options may be available through your account settings or by contacting support.

We may suspend, restrict, or terminate access when we reasonably believe that:

  • You violated these Terms;
  • Your activity creates legal, security, or operational risk;
  • Your account is being used fraudulently or without authorization;
  • Payment obligations remain unresolved;
  • Suspension is required by law or a valid governmental request.

Following deletion or termination, content may remain temporarily in backups, security records, payment records, or other systems where retention is reasonably necessary or legally required.

You are responsible for exporting information you wish to preserve before deleting your account or ending your subscription.

11. InsiQuest Intellectual Property

InsiQuest software, source code, platform design, trademarks, logos, branding, documentation, templates, interfaces, and related materials are owned by Best Partner Media LLC or its licensors.

These Terms do not transfer ownership of InsiQuest intellectual property to you. You may not copy, resell, sublicense, modify, reverse engineer, distribute, or create derivative services from InsiQuest except as expressly permitted by law or in writing.

You may use the platform and its features only for your authorized internal or business purposes during the period in which you have lawful access.

12. Third-Party Services

InsiQuest may rely on or connect with third-party providers for hosting, storage, payments, artificial intelligence, email, notifications, authentication, analytics, or other functions.

Third-party services may be governed by their own terms and privacy practices. Best Partner Media LLC is not responsible for third-party services outside its reasonable control.

13. Service Availability and Disclaimers

InsiQuest is provided on an “as is” and “as available” basis to the fullest extent permitted by law.

We do not guarantee that:

  • The platform will always be available or uninterrupted;
  • Every feature will operate without error;
  • Survey delivery or response collection will always succeed;
  • AI-generated output will be accurate or appropriate;
  • Data exports will satisfy every external compliance requirement;
  • The platform will meet every individual business or legal need.

Scheduled maintenance, emergencies, third-party outages, security events, internet failures, or circumstances outside our control may affect service availability.

14. Limitation of Liability

To the fullest extent permitted by law, Best Partner Media LLC and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to InsiQuest.

This includes damages relating to lost profits, lost opportunities, reputational harm, lost responses, respondent claims, unauthorized account activity, service interruptions, reliance on AI output, or loss or corruption of data.

To the fullest extent permitted by law, the total liability of Best Partner Media LLC for claims arising from or relating to InsiQuest will not exceed the amount you paid to Best Partner Media LLC for InsiQuest during the twelve months immediately preceding the event giving rise to the claim.

Some jurisdictions do not permit certain liability limitations, so portions of this section may not apply to you.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Best Partner Media LLC and its owners, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from:

  • Your surveys, content, or use of respondent information;
  • Your violation of these Terms;
  • Your violation of applicable law;
  • Your infringement of another person’s rights;
  • Your misuse of InsiQuest or its AI features.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in the platform, business practices, legal requirements, or security needs.

Updated Terms become effective when posted unless a later effective date is stated. Continued use of InsiQuest after updated Terms become effective constitutes acceptance of the revised Terms.

17. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law rules.

Any dispute that is not otherwise resolved by agreement will be brought in a court of competent jurisdiction located in New Jersey, unless applicable law requires a different location or procedure.

18. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Failure to enforce a provision does not waive our right to enforce it later.

You may not transfer your rights or obligations under these Terms without written permission from Best Partner Media LLC. We may transfer these Terms as part of a merger, acquisition, reorganization, financing, or sale of assets.

These Terms and the Privacy Policy constitute the agreement between you and Best Partner Media LLC regarding your use of InsiQuest, except where a separate written agreement applies.
